PhpNuke Support Forum / bogus complaint 'stopforumspam'
September 27, 2011, 08:05:24 AM
I'm positive. Me and S Hunh in the other thread, our sites have been centered around the same simulator hobby for almost five years now. And I received no warning or anything via my email on regard to any TOS violation.

All that said though, the site is now functioning with the TOS error not popping up. I'm not sure if that is something you did on your end, but if so, greatly appreciated.

It's okay Gary, relax man (it's all over) Your video game beach track with the little pecan house in it is safely tucked away at Bill's (nobody is going to steal it away from you) You should just settle down, draw in a deep breath, hook up your 'computer wheel' and go for a nice long soothing drive.

Know what I mean? -- You'll get there fast and then you'll take it slow, that's where you wanna go...

Geez honestly, do you not know when to quit Gary Champagne? If we did not co-author that track, then why would Bill Anderson be listing us as 'creators' here -- NORTHWEST RACING

You can look at every track you've supposedly created Mr. Champage on Bill's own site, and who is listed on every single one? -- Mr. Denis Rioux who distanced himself as I did from the both of you years ago (fact is, you can't make a track without assistance which is why you haven't made one since) You are aware that everybody who is a member of my site is reading your comments here no doubt, right? Unlike yours here under 'wranglers tracks' NORTHWEST RACING The imaginary one Bill links to that doesn't even exist because you don't create anything...Can you honestly not come off as anymore jealous of the work that we contribute in our own spare time or what?

You know php nuke hasn't even ruled one way or the other Gary, haven't you received what you both set out to accomplished yet? The links to everything 'gn63' have been removed (I wasn't ordered to do that yet) It should be really clear to anybody (especially the administrators here at nuke) what this is really about (you're making that case for me) -- you want my site gone because Bill's is a failure (only thirty-thousand hits in over a year?) Plus, you don't have a web site aside from the phony link Bill maintains for you...

Bill has clearly come on here revealing that he chases web hosts like ambulances just to be vindictive. Plus you guys routinely spy daily on both of our forums because you have nothing better to occupy your time with.  And you can tell the guy (in Germany) that perhaps he should leave the work of modeling American cars to those who actually reside in North America and know what they look like.

Good luck with harassing his web host for something to occupy your time with now Bill, but I think we're done here (this is php nuke forum and any issue you have outside of that is irrelevant)  Same as me continuing on that Bill Anderson is a 62 yr old man who has been hooking himself up to a fake steering wheel to play car racing video games online since 1995. See what I mean with that? Totally irrelevant.

Also in response to the 'the nazi video' (I guess Gary is inferring that I in someway a nazi now?)

Here's some clarification on that, when our group did in fact release a modification for this thing last year (with nothing to do whatsoever with Gary or 'the wrangler' as he portrays himself)

-- Gary essentially got jealous to the point in where attempted to sabotage a release thread for that modification to the dismay of an entire forum to the point in where the moderator of that forum had to discipline him along with locking the thread itself Rubbin's Racin' • View topic - Rioux's sprint cup mod was released this evening.....

As a result of that, I lampooned Gary on youtube putting together the popular at the time 'hitler reacts video' similar to here YouTube - Hitler's reaction to Final Fantasy XIII on the 360

Gary's actions in that thread were honestly similar to an irate Hitler and totally overblown which is why he no doubt recalls it. But Gary is the type to stretch the truth on most any matter (inferring I am a nazi or whatever he can come off with to score points on here) No doubt this all irrelevant, but if he is going to attempt to tie me into 'nazi videos' I think that's going a little overboard. In effect similar to this entire situation in where you have grown adults crying copyright infringement over essentially artwork added to a video game.

Thanks.

I stand by everything said at the desmods forum about Gary Champagne & Bill Anderson (which is irrelevant here to start with)

Does not change the fact that Bill clearly alters the wording around on his website daily (that's been proven and is relevant to this entire matter)

What you linked above just reinforces that again. We're quite capable of producing projects on our own Gary which you're fully aware, and which is why we co-authored that track at your request (and why Bill attempted to hide that fact here)

That being the case all of the work (original work of my own which has been demonstrated here) in relation to the unpopular gn63 modification has been removed off my site as of last night. So honestly, I don't see what else either you or Bill are left here to complain about seeing as how all of the other modifications (and material related to them) are solely of our own creation.

On a final note, just to demonstrate how Bill alters the wording, permissions, among other things on his website on almost a daily basis (and to demonstrate the obvious lie leveled here by 'wrangler' as to me photo-shopping his site page) -- here is a cached link of Bill's site from only yesterday NORTHWEST RACING

Clearly you can see that he has altered the credits listing of the track from what it read only yesterday morning. Here's is what it displays this morning NORTHWEST RACING

Thank you.

You could compare each individual file I am hosting similar to this and instantly see as evident here the drastic differences. This isn't a dispute about stealing or modifying anything Bill is hosting, rather it's a ploy to get my files (and hopefully my website revoked in the process) simply because Bill feels my artwork is a threat to his own and hence more desired in the simulator community. It doesn't take long just by browsing both sites for this to become plainly obvious. The stuff he is accusing 'infringement' of consists of not even 5 percent of the total artwork available on my website on top of it all. 'gn63' as it is called is over a year old, since that time I have been working projects with others totally independent of anything Bill or Gary can lay claim to. It is in their interest to hopefully sabotage the current progress of those projects by wasting my time & energy in order to rebuild or reestablish my personal website.

As evident here scores in the community are freely painting (as I have done) their own personal work in relation to gn63. In fact, the latter one even gives credit to me 'sb70' seeing as how he opted to use my own stand alone art work (my template) to base his own artwork (or simulation paint from)

I have enjoyed the services of php-nuke (my site is approaching on four-hundred thousand visits with a total membership upwards of two-thousand) Hopefully a bogus claim of 'infringement' in relation to my own personal artwork will not spell the end of such a long established site.

As for 'Wrangler' and his claim of infringement regarding the track...

First of all the claim that I am 'photo-shopping' screen shots (totally unfounded) You can plainly see Bill routinely alters the wording on his main page as evident just today! If in fact you go to the page again it has switched back from listing myself and Denis Rioux as co-authors as it was just this morning here -- http://img251.imageshack.us/img251/4662/trackauthors.jpg    -- to just 'wrangler' and various others tonight here -- NORTHWEST RACING

As far as the track goes, again I am not hosting the track (I am merely hosting my own artwork the same as applies to the bogus claim of 'infringement' with the car mod) Again, the downloader would need to first obtain the track at Bil's site and then in turn they could download my original artwork as a means to customize it with if they so desired. Furthermore before Wrangler even released the track to the public, he provided me a copy of it to volunteer my own artwork & time into it (Bill is in fact hosting a track using portions of my own artwork that I have not even granted him permission in using) Denis Rioux's material as well for that matter which was essential in creating the track in the first place (which again no doubt is his reasoning for yet again altering the co-authors on his page listing) Below are some visuals (Gary's art work top and mine bottom as applies to the art work I have created in relation to the track)

To begin, I'm going to address the admin here with both explanatory & visual comparisons. First up this 'gn63 mod' (or modification for a racing simulator released in 2003)

I am not hosting the modification and or any of the files released with that modification (I've created my own that are completely stand alone consisting of my own art work) In other words since I am not hosting the modification the downloader would first have to obtain the modification from Bill's site, then in turn if they so desired download my artwork to customize it with. Below is a visual example which is honestly really telling. Top picture is Bill's artwork that he is hosting for one of the four models available with the modification. That's his template (car details such as the grille, body lines, interior, etc.) and he painted it to depict Fireball Roberts 1963 Ford.

Next up is all of my own work art work. I created the details for both the car inside & out and paint job. Keep in mind what I am hosting is strictly my own art work (not the model itself) Once downloaded you receive a 1024 by 1024 image of my original art work and that's all. You can plainly see paint, body lines, every detail is drastically different from anything Bill is hosting. So the case here is Bill is attempting to censor my artwork under false grounds of 'infringement' because he feels it is upstaging his own attempts. You can visually compare & download between both sites everything I am hosting in relation to the modification and easily discern between my art work & Bill's (click on images to fully expand)

Can I ask what recourse do I take if Bill refuses to show up here to resolve this? Perhaps I misunderstood 'soon' because it's been well over two hours now and I am aware that he is in fact online at another website. Honestly this is a matter that could be resolved here within minutes without any unnecessary arguing or needless back & forth.

Unlike me with my site, he stands to lose nothing over this. It's a simple issue here of an infringement accusation leveled by him and I invite Bill to please be specific on the matter in regard to what in particular I have infringed upon here to demonstrate his position. Short of that my site consists of a large body of work he in no way can even remotely lay claim to.

Thanks again.

Continued....

Now the owner of that website habitually changes the wording on his website, so here is the current page at the time of this writing if it has in fact been changed -- http://img251.imageshack.us/img251/4662/trackauthors.jpg

Furthermore he has given full permission for these files to be hosted (the track in particular which is what he is upset about) -- the rest of the stuff doesn't infringe upon him whatsoever. Here's his original wording giving permission before he had later changed it -- "This track may be edited and Redistributed in any form" http://img261.imageshack.us/img261/6523/permission.jpg

I have had dealings with Bill Anderson in the past. He has routinely spread lies about me among other things. Not only is this my word, this can be confirmed by the current group I do make projects with at Desmodsracing.com (what you will see on the main page of there like my website, is again my own work & contributions and that is not in dispute) Essentially the situation here is Bill feels threatened (no doubt jealous) that my work which I produce and offer to the public freely is upstaging his own in whatever way. I have had this site for almost 5 years now, it's a respected site as far as content is concerned in the hobby community that it is centered around, and I have invested a lot of my own free time into it.

That's not to say I do not understand the concern, but this appeal of his is baseless & without merit whatsoever. I look forward to further correspondence with php nuke on this matter. Lets hope before three days at least.

My website url is as follows: http://houseofhardtops.freephpnuke.org/

Thank you.
